How our media may be used. All content we produce is our copyrighted work, licensed to you for the listing it was created for.

This Real Estate Listing Content Licensing Agreement ("Agreement") applies to all photography, video, drone media, floor plans, 3D tours, virtual staging, and any other media ("Content") produced by Buffalo Homes Media & Marketing ("Buffalo Homes," "we," "us"). By ordering, paying for, downloading, or using our Content, you ("Client") agree to this Agreement.
All Content is the original, copyrighted work of Buffalo Homes. We retain full ownership of all copyrights in the Content at all times. No sale of prints, files, or services transfers copyright. Nothing in this Agreement is a "work made for hire" arrangement, and no ownership rights pass to the Client, the property seller, a brokerage, or any third party.
Upon full payment, we grant the Client a non-exclusive, non-transferable license to use the Content solely to market the specific property listing for which it was produced. This includes use in the MLS, listing portals and syndication feeds (such as Zillow and Realtor.com), brokerage websites, social media, print brochures, mailers, and advertising for that listing.
The license belongs to the Client who ordered and paid for the Content. It does not extend to other agents, teams, brokerages, sellers, buyers, builders, stagers, or any other party unless we agree in writing. Third parties who wish to use the Content, including a new listing agent if the property is relisted, must purchase their own license from Buffalo Homes.
The Client may also use the Content in their own professional self-promotion (such as "just listed" and "just sold" posts, portfolios, and listing presentations), provided the use relates to the listing for which the Content was produced. Credit or a tag when posting on social media is appreciated but not required.
Unless we agree in writing, the Content may not be:
- Resold, sublicensed, shared, gifted, or transferred to any third party.
- Used to market a different property, project, or business.
- Used by a party other than the licensed Client, including reuse of photos from a prior listing by a new agent or owner.
- Materially altered beyond basic cropping and resizing, including removing watermarks or metadata.
- Submitted to stock media services, used to train artificial intelligence models, or entered into contests.
The license begins when payment is received in full and continues while the Client markets the listing, including reasonable self-promotion afterward under Section 4. The license for active property marketing ends when the listing agreement between the Client and the property owner ends, whether by sale, expiration, or withdrawal.
No license exists until payment is received in full. Use of Content before full payment, or after a returned or disputed payment, is unlicensed use.
Unlicensed use of the Content is copyright infringement under federal law (17 U.S.C. § 101 et seq.). We reserve the right to invoice retroactive licensing fees for unauthorized use and to pursue all available legal remedies, including statutory damages and attorneys' fees where applicable.
Buffalo Homes retains the right to use all Content in our own portfolio, website, social media, and marketing.
This Agreement is governed by the laws of the State of New York, with exclusive venue in Erie County, New York. If any provision is found unenforceable, the remainder stays in effect. A separate signed agreement with Buffalo Homes controls over this Agreement if they conflict.
