These Terms & Conditions ("Terms") govern your use of the Buffalo Homes Media & Marketing website (the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Buffalo Homes Media & Marketing ("Buffalo Homes," "we," "us") is a real estate media and marketing company based in Buffalo, New York. You can reach us at Contact@BuffaloHomes.co.
Information on the Site, including package descriptions and pricing, is provided for general reference and does not constitute a binding offer. Prices are subject to change. Totals shown by our scheduling tools are estimates only; final pricing is confirmed with you before any work begins. Submitting a scheduling or consultation request does not create a confirmed booking until we confirm it with you directly. Client engagements are governed by the terms of the applicable invoice or service agreement, which control over these Terms if they conflict.
Unless otherwise agreed in writing, services are billed by invoice and payment is due as stated on the invoice. We may suspend delivery of media or services for accounts with unpaid balances.
Unless otherwise agreed in writing, all photography, video, floor plans, virtual tours, and other media we produce remain the intellectual property of Buffalo Homes. Clients receive a license to use delivered media for marketing the specific property or business for which it was produced. Delivered media may not be resold, sublicensed, or transferred to third parties without our written permission. We reserve the right to display work we produce in our portfolio and marketing unless otherwise agreed in writing. Full details are in our Real Estate Listing Content Licensing Agreement.
All content on the Site, including text, images, video, graphics, and logos, is owned by Buffalo Homes or used with permission, and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission.
You agree not to misuse the Site, including by attempting to interfere with its operation, submitting false or misleading information through our forms, using automated tools to scrape or harvest content, or using the Site for any unlawful purpose.
The Site contains links to and embedded content from third-party platforms, including YouTube, Instagram, and Facebook. We are not responsible for the content, terms, or privacy practices of third-party services. Your use of those services is governed by their own terms and policies.
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Buffalo Homes will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold Buffalo Homes harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Erie County, New York.
We may update these Terms from time to time. The effective date above reflects the latest revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
